Phi-4 weights are not yet meant for consumption via HF registry. This premature upload is done by a user that's neither co-author nor MSFT FTE and appears in violation of good will from MSFT. The authors have the right and obligation to finish all the validation before public release of weights to HF.

They broke their promise to upload the model this week so I can't say it's immoral for a 3rd party to upload it either.

Speaking as a lawyer specializing in IP rights, there is no legal issue here.
At most you have a contractual violation between MS and the original uploader. However since it is available for free on MS's own website there are no damages and thus nothing to sue over. If MS wishes to file a DMCA takedown notice with HF they are free to do so, but until then the safe harbor provisions of the DMCA apply here.
